A law passed in November 2025 redefines hemp to cap total THC at 0.4 milligrams per container โ that would wipe out roughly 95% of what's on shelves today, including delta-8, THCA flower, THC gummies and drinks, and even most CBD products.
The effective date was November 12, but a stopgap funding bill signed September 2 pushed it back 30 days to December 11. Before that, on November 12, synthetic cannabinoids the plant can't naturally make become federally illegal.
People use hemp for pain, anxiety, sleep, and inflammation. Pet owners use CBD for dogs with arthritis, anxiety, and calming during storms or fireworks. That's part of why this ban stings โ it's not just smoke shops. It's people managing chronic pain and pet owners trying to help their dogs.
The White House has pushed for regulation instead of a ban, and bills exist to delay it to 2028 or repeal it outright โ but none have moved past committee. So selling is still legal right now. But if you're in this space, December 11 is the date to watch.
