The political balance of the state's courts has been widely credited as a part of Delaware's corporate law success. But it seems that under the settlement, Delaware would never need to appoint another Republican.

I should add that people who are in a position to know say they believe Lachmund will be a good Vice Chancellor. My comments here are about the apparent rupture with longstanding practice (and law) as to partisan balance on the Delaware courts, not about him personally.

Talked about exactly this in the @cyberbulls that is airing right now. There is not enough scrutiny on the proxy advisors (ISS, Glass Lewis, ...). And the fact that they oppose TX as a new corporate domicile is just one of the many conflicts they have.
The proxy advisors themselves face a conflict of interest in making recommendations on these moves because they are locked in a battle with Texas. There hasn't been enough scrutiny of ISS and Glass Lewis in this context.

Nice post on the lex Rhodia. The assimilation into Roman law is interesting: the duty to contribute was interpreted by the jurists as an aspect of good faith in the contract of carriage, entered into by merchants with the ship's business manager (magister navis)...
When a ship is at risk, it's sometimes necessary to throw some of its cargo overboard to save it. But who decides whose cargo is thrown? To avoid counterproductive bickering in times of danger, the ancient Greeks widely adopted a law from Rhodes: "Lex Rhodia de iactu," which states that financial losses for thrown cargo are equally shared among all cargo owners on the ship. So ,since losses are shared, the owners of heavy, cheap items didn't fight to stop the crew from dumping their property, because they knew they would be compensated by the owners of lightweight luxury goods. This Rhodian law was later adopted by the Romans and, through transmission, became the basis of modern maritime law regarding jettisoned cargo.

I have been able to find a lot of articles recently written by law professors that contained large sections copied and pasted from AI. I think this is actually going to be a bit of a scandal.

Here’s what I think happened: A lot of early adopters of AI realized that you could write articles very quickly by using it. Public awareness of the AI detection tools was lower then, so people thought they could get away with it. Now they are cooked, to borrow a term from my kids.

I personally believe academics should be able to use AI material for many or even most purposes in their writing. But I do think most people think you can't copy and paste from AI output into your article. Maybe I'm wrong!
