According to reporting by the Associated Press, the Supreme Court ruled in June 2026, 5–4 to reject a challenge to state voting laws.
The court stated that Congress—not the executive branch—has the power to set federal election day rules. This means states can still count mail-in ballots that arrive after Election Day, as long as the postal service postmarked them on or before Election Day.
States set their own deadlines for receiving and counting mail-in ballots, as the U.S. Supreme Court ruled in June, that President Donald Trump's Executive Order attempting to ban late-arriving ballots was invalid.
