So there is another recusal question that deserves scrutiny: Justice Elena Kagan wrote the foreword to the federal judiciary’s Reference Manual on Scientific Evidence, specifically pointing judges toward climate-science litigation and falsely describing the manual as a “dispassionate guide.” The climate chapter was subsequently REMOVED by the Federal Judicial Center, and the National Academies admits questions about how it was produced warrant an independent review. Under federal law, the test is whether a Justice’s impartiality “might reasonably be questioned.” So what is Justice Kagan’s answer? Recusal, or hypocrisy?
