🧵You may feel the following is angels dancing on pinheads but the 2nd doc highlighted here is crucial ‘shareholder's equity + loans are not subsidies under any applicable definition; they are the means by which the Abu Dhabi government has sensibly invested in a successful business mode’
From Etihad Airways 60-page submission to John Kerry, US Department Secretary of State, Antony Foxx, US Department of Transportation Secretary and Penny Pritzker, US Department of Commerce Secretary on May 31, 2015

A couple of points. MCFC have insisted for years that the club is a private investment from Sheikh Mansour. By arguing now that actually the bulk of funding comes direct from Abu Dhabi govt. they seem to be abandoning that conceit. As we’ve always said, it’s a state owned club

Essentially it does seem that ‘irrefutable body of evidence’ is that the money is what we say it is. If we say it’s equity investment it’s equity investment. It might look, smell and taste like a subsidy/disguised funding but it is in fact an equity investment in Etihad

Curiouser and curiouser As @DamianHastie points out, in 2015 the US depts of Commerce, State + Transport launched an inquiry into whether Etihad were receiving govt subsidies Etihad statement to commission was: "The assertion that the Abu Dhabi government paid for Etihad's sponsorship of English Premier League football club Manchester City is … false. In 2011, Etihad and Manchester City entered into a 10-year sponsorship agreement, which included naming rights for Manchester City's stadium. Etihad funded this sponsorship from its own liquidity’

Interesting that in 2015, Etihad categorically said they didn't get government funding. I am now confident they will never take the PL to court, as when you couple with other statements they don't look a great witness.

To clarify, as @Lawton_Times points out City have already run this argument, known in judgement as CPC explanation. Commission rejects this as back projection explanation which a concocted after they were charged
Which would still be a breach of the rules because they claimed it was from commercial sponsors *Long + tedious thread incoming about how far Abu Dhabi can be separated from its state companies
