As a corporate lawyer, I've been incorporating companies for 17 years, & it's a mess. Somehow we really got robots & AI before a halfway decent startup app. So I built it myself--oneshot formation, cap table, governance and onchain identity for your startup today.

Anthropic calls some AI distillation illicit. But is distillation illegal? This @LawofCodeFM podcast is a deep dive into how courts might rule, with @dbarabander, @sabina_beleuz and @PossibltyResult, who co-authored one of the sharpest papers on the topic. We cover X v. Bright Data, what frontier labs' terms say about outputs, why Anthropic's own fair use arguments could be turned against it and predictions for the future. some noteworthy things about this: (1) these foundations are set up to owe no duties to anyone; contrast a corporation where the board owes fiduciary duties to stockholders (U.S.) or at least to the company itself (other countries) (2) if this were a Cayman Islands foundation, there would likely not even be a slim chance of any kind of remedy or action....because it's Swiss, there is a regulator of sorts and there are some standards at least for getting to keep the tax-exemption privilege, that's why there can be some kind of challenge here..note that it's not a lawsuit by the injured parties (the investors) but rather basically asking the government to investigate whether the foundation has violated its own rules...my guess is that this will be a tough case to make, as the rules are probably drafted as "boilerplate"/non-commital as possible....only if there is deep self-dealing or fraud (as opposed to mere total incompetence and disregard for investors) is there likely to be any kind of corrective action (3) BORGs were my solution to this & have been steadily taking market-share from the blank-check "Foundation"model; however, just because something is a BORG does not mean it's a great solution to this, you have to look at the details as there are many ways to astroturf transparency and accountability...the BORGs done by @MetaLeX_Labs, e.g. for @MetaDAOProject , @umia_finance , @LidoFinance , @yearnfi , create very detailed rules and give third parties the ability to trigger lawsuits against not only the entity, but also its personnel...they work quite a bit like business trusts...this gets you real protections as a token investor, albeit different from the fiduciary duties path used in corporations....

AI will be the next way to stratify ruling from non ruling. Those that learned later in life have at least the neural pathways of critical thinking. Those that come after will not have the opportunity to struggle and develop these pathways in the same way … so basically critical thinking will become a lost art. Artisanal thinking

Geoffrey Kendrick sees $ETH outperforming $BTC through 2030. $4K ETH by the end of the year, $40K by 2030. "ETH BTC, which is now just above 3%, I have going back up to 8% by 2030, which is roughly where it was in the 2021 DeFi summer." The value capture is indirect but inevitable. When TradFi arrives onchain, they want the oldest, most trusted rails. FT @StanChart @BitcoinJesusETH @Nexo
Geoffrey Kendrick has a 70x thesis on Arbitrum. The bet: Robinhood is only the beginning. If more brokers and financial firms launch onchain using Arbitrum’s stack, protocol revenue could jump from roughly $4-5M a month to $40-50M. The catch? ethereum:0xb50721bcf8d664c30412cfbc6cf7a15145234ad1 still needs better value capture. this is what I would've expected and will only get worse. the narrative that AI won't decimate the junior ranks of the profession is absurd....it begins long before they have even decided to enter the profession as humans in general (including the ones who might later be interested in legal careers) will evolve increasingly into meatproxies. .. .the predictable result is an AI-powered gerontocracy practicing cybernetic law . . .they simply won't need (nor have time/patience to "train") new lawyers. . .
AI made junior lawyers better at drafting and worse at learning. A three-month randomized trial with 133 patent lawyers at 11 US firms found junior lawyers showed zero (!) average knowledge gain when tested on a no-AI redlining task afterward.

There's a banger in The Sovereign Individual I like a lot: "The good news about individual liberation and autonomy will seem to be bad news to many who are frightened by the transition crisis and do not expect to be winners in the new configuration of society." I think that's the most useful way to read the pushback against Bitcoin, stablecoins, AI, etc. A lot of jobs and businesses sit on top of some artificial moat. Capital controls, gatekeepers, middlemen, all of it. If your spot depends on that moat, more freedom for everyone else looks like a threat to you, and honestly it is. I think we're in something like a multi-decade (or longer) transition that nobody alive today will see the end of.

If there is any ai regulation that is needed it’s transparency around throttling, quantization, which model is actually being served, etc. Probably is already covered by consumer protection tbh
