The New York law obviously already reflects that. It does not state, as the Governor implies, that having a drink equals consent. It only affirms that having a drink does not take away one's ability to consent. There is no "loophole" to be closed. If she means she wants to change the law so that people who have had a drink of alcohol can no longer consent to sex (which is obviously what she means), she supports reclassifying a majority of consensual sex as rape
Choosing to have a drink is not consent, and it’s never a license for sexual assault.
New York law should reflect that.
I support closing the voluntary intoxication loophole and will work with the Legislature to get it done.
