Just a heads up on what to expect!
A generation of women raised to believe talking about the facts of a case is “victim blaming” have been robbed of opportunities to learn how better to protect themselves.
Statements like this are why men often don’t report being victims of sexual assault
Forcing non-consensual sexual acts is a criminal offense for anyone nationwide
Federally, rape is defined as “penetration without the victim’s consent” and is gender-neutral
At the state level, “rape” sometimes requires specific anatomical penetration, but women can be prosecuted for sexual assault, criminal sexual conduct, sexual battery, or unlawful sexual contact if a man doesn’t or can’t consent
New York Law doesn’t say having a drink is proof of consent
The law says that having a drink isn’t proof of LACK of consent
If someone is voluntarily drunk and is physically forced, is physically incapacitated (like if you’re passed out), or says no, that’s rape
There may be instances of MENTAL incapacitation that are not clearly covered by law (like if someone clearly doesn’t know where they are or what’s happening to them or can’t form a coherent sentence)
And those instances 100% should clearly be defined as rape since the person obviously CANNOT make a rational decision in those circumstances but that’s very different than simply “choosing to have a drink”
However, if she wants to make any subjective amount of voluntary intoxication the SOLE proof of incapacitation and inability to consent, that’s ridiculous for a few reasons
1. It removes the hard line between consent and non consent without using breathalyzer tests or having the ability to read minds
2. It removes the ability to decipher who’s the victim and who’s the assailant since it’s often that BOTH people are intoxicated to some degree
3. It makes taking substances with the intent of having sex (which is very common) inherently a crime
- Some people go to parties and drink to ease their anxieties about wanting to make a move on their crush
- Some people go to bars looking for attractive strangers to hook up with
- Some people go to hippie music festivals to take drugs and have orgies
- Some people drink during dinners with their significant other and go home to celebrate
People have the right to do what they want with their bodies and that right comes with responsibilities
If you voluntarily take substances, you are responsible for the decisions you make while on them
If you don’t want to be held responsible for conscious decisions made while voluntarily intoxicated, don’t get intoxicated
Choosing to have a drink is not consent, and it’s never a license for sexual assault.
New York law should reflect that.
I support closing the voluntary intoxication loophole and will work with the Legislature to get it done.

There is no law in New York saying choosing to drink means consenting to sex.
Current New York law says voluntary intoxication does not invalidate an individual's ability to give consent, as it does not meet the state's standard of "mentally incapacitated".

In America we assume innocence until proven guilty for everyone
Insisting the men are rapists is an unproven accusation
Insisting Jane Doe lied about everything is also an unproven accusation
Wanting justice is virtuous
Pretending you already have all the facts is not
People don’t seem to understand that men and women ARE treated equally under the law when it comes to rape and false accusations
Forcing sex, drugging someone, or having sex with a person who is incapacitated are all rape, whether the perpetrator is a man or a woman
Publishing a false damaging public claim is defamation for both men and women
Making an intentionally false report to the police is a crime for both men and women
The difference between the way men and women are treated in these instances is due to SOCIAL ISSUES, not legal issues
Those harms are real for both sexes
Pretending they’re the legal system’s fault doesn’t help anyone
And trying to get revenge on the entire opposite sex for the stupid decisions of a few idiots makes things worse for everyone
If someone makes a public false accusation that’s defamation and yes they should be in jail
But if someone goes to police or files a lawsuit that’s a different situation
What a lot of people don’t understand is that a lot of women are lied to about the definition of rape so it’s easy to innocently come to the conclusion that they’ve been assaulted given the false definition they’ve been given
And in that case I don’t think a woman should be punished for what she doesn’t know as long as she goes through the system the right way
And if it was all a false lawsuit, it would come out in the investigation which is why we all need to wait before judging
Rape is one of the worst crimes a person can commit
We should demand justice and if the allegations are true, the men should be locked away for life
And if they aren’t true, we shouldn’t ruin the lives of innocent men
I know it’s hard but justice for all means having patience
The fact that there are so many different fragmented documents, texts, and statements all with conflicting information is proof that WE DON’T KNOW WHAT HAPPENED THAT NIGHT AT CORNELL
So can everyone please stop adding fuel to the fire and wait for a real investigation before jumping to conclusions?
Except people are vastly richer than they were 40 years ago. The funniest proof is that an actual 1980s standard of living would be relatively cheap today.
No smartphone, internet, streaming, modern computer, flat-screen TV, modern medical technology, next-day delivery or countless other improvements now treated as necessities.
The wealth didn’t “trickle down.” New wealth was created, and yesterday’s luxuries became today’s expectations.
People are about twice as likely to approve of **coal plants** being built nearby as opposed to data centers.
Coal plants use more water and pollute more. They create comparable noise pollution. There's no way this makes sense outside a media panic.
STOP comparing Afghan women in burqas and Iranian women under compulsory hijab with Christian nuns.
This really isn’t complicated.
A nun chooses to become a nun. Her vow applies to her. She doesn’t take the vow and suddenly every woman in Italy has to cover her hair.
And if she removes her veil, the morality police don’t show up to beat her, arrest her, or throw her in prison.
That’s the difference.
In Iran and Afghanistan, the rules don’t care whether you’re religious, secular, Muslim, atheist, or just want to be left alone. You’re a woman? Congratulations. The authorities have a dress code for you.
And please stop pointing at little girls in hijab and calling it “choice.” Some of these children can’t even read yet. They’re old enough to choose a religious obligation for life, but apparently not old enough to choose what they want for lunch?
Here’s the test nobody seems to want to take:
What happens when a woman says NO?
If the answer is guns and bullets, prison, beatings, losing your education, or being erased from public life, congratulations, you’ve discovered the difference between choice and coercion.
And if you still think the Taliban model is somehow “liberating,” try it yourself. Cover up. Obey. Let religious authorities decide how you dress, where you go, whether you work, and when you’re allowed to speak. Then explain to Afghan women how empowered you feel.
Is this really that difficult to understand?
